Frequently Asked Questions
A final settlement typically includes four components: end-of-service gratuity (21 days of basic pay per year for the first 5 years, 30 days thereafter, capped at 24 months of basic salary), payment for accrued unused annual leave, notice period pay where notice is paid in lieu of being worked, and any outstanding salary for days already worked.
Under the UAE Labour Law, all wages and end-of-service entitlements must be paid within 14 days of the contract end date. Delays can be escalated to MoHRE (Ministry of Human Resources and Emiratisation).
Yes. Under Federal Decree-Law No. 33 of 2021, employees who complete at least one year of continuous service are entitled to full gratuity on the same formula whether they resign or are terminated - the old reduced-gratuity rules for resignation were abolished.
Compensation in lieu of notice is based on your full wage (basic plus allowances) for the notice period, per Article 43. This differs from gratuity and leave encashment, which are calculated on basic salary only.
Unused legally-accrued annual leave must be cashed out at your basic daily rate (basic salary divided by 30) for each remaining day, added on top of your gratuity.
No. The Article 51 cap of two years of basic salary applies only to the gratuity component. Leave payout, notice pay, and pending salary are separate entitlements paid in addition to the capped gratuity.
